TERMS OF SERVICE

2. Rental Requirements

• Age Requirement: All renters must be at least 21 years old with a valid government-issued photo ID.
• Boating License (Bareboat Only): For self-drive bareboat charters, renters born on or after January 1, 1988, must possess a Florida Boating Safety Education Identification Card.
• Captained Charters: No boating license required for captained charters; our licensed USCG Captain maintains full control.
• Insurance: All guests are covered under Muniz & Son's comprehensive marine liability insurance during official rental periods.

3. Booking & Payment

• Reservation: Bookings are confirmed only after verbal confirmation from Giselle Muniz or authorized crew member.
• Deposits: A 25% non-refundable deposit secures your time slot (applied as credit toward final rental cost).
• Final Payment: Balance due at ramp/dock prior to departure.
• Payment Methods: Cash, Venmo, PayPal, or credit card accepted.
• Fuel: Fuel is NOT included. You pay only for fuel consumed at prevailing marina rates.

4. Cancellation & Refund Policy

• Cancellation by Guest:
  • More than 7 days notice: 75% refund of deposit
  • 3-7 days notice: 50% refund of deposit
  • Less than 3 days: Deposit forfeited (applied as future credit)
• Weather Cancellation: If USCG issues small craft advisories or dangerous conditions, full refund or reschedule at no charge.
• Operator Cancellation: Muniz & Son reserves right to cancel for mechanical failure or safety concerns—full refund issued.

5. Vessel Use & Safety

• USCG Compliance: All vessels are USCG-certified with current safety inspections and proper life vest capacity.
• Life Jackets: Life jackets provided for all sizes (infant through 3XL) at no charge.
• No Glass Containers: Strictly prohibited on boat or swim deck. Cans and plastic containers only.
• BYOB Policy: Alcoholic beverages permitted only if guests are 21+; captain may refuse service to intoxicated individuals.
• Compliance with Operator: Renters must follow captain's safety instructions at all times.

6. Damage & Loss Liability

• Normal Wear: Normal wear and tear covered under insurance.
• Intentional Damage: Renter liable for intentional or negligent damage (collision, grounding, fuel contamination, etc.).
• Lost Equipment: Renter liable for cost of lost safety equipment, anchors, or onboard items.
• Liability Waiver: All renters sign liability waiver before departure.

7. Environmental Responsibility

• Renters must respect protected areas and wildlife.
• No trash or debris left on boat, at sandbars, or in water.
• Marine life disturbance (dolphins, manatees, birds) is federal offense; observe from distance.

8. Limitation of Liability

Muniz & Son Rentals shall not be liable for personal injury, loss of personal property, or consequential damages arising from use of rental vessels, except as prohibited by law. Renters assume all risk of personal injury while using rented vessels.

9. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Florida. All legal proceedings shall be held in Hillsborough County, Florida.
